New Caney ISD Allows Coaches to Violate The Constitution, and Even ISD Policy!

          Serious conflicts of interest may have ruined the future of one New Caney ISD Student.  Annie Louise DeLaval was injured during soccer practice on or around January 17th, 2015. She and fellow teammates had a conversation on Twitter about herself and other teammates getting injured and brainstorming before a meeting with coaches a few days later. As a result of Ms. DeLaval and her friends' conversation, and their subsequent airing of grievances with the soccer coaches, Annie has been kicked off of the New Caney Soccer team. This is a direct violation of the First Amendment of the Constitution, as well as the District's own policy.

Students do not shed their constitutional rights to freedom of
speech or expression at the schoolhouse gate. At school and
school events, students have First Amendment rights, applied in
light of the special characteristics of the school environment.
Student expression that is protected by the First Amendment may
not be prohibited absent a showing that the expression will materially
and substantially interfere with the operation of the school or
the rights of others.

          Adding insult to injury, Ms. DeLaval alleges that the coaching staff has made life unpleasant for her while attending classes after the fact. These individuals are engaged to be married, so there really is no impartiality to this bad situation already made worse. The coaches whisper among themselves in the hallways when Ms. DeLaval goes from class to class, and she states that it seems like they have attempted to turn her teammates against her. On top of her injury caused during practice, Ms. DeLaval now faces having to enroll in another school, so that she may continue in the sport. Annie has several college recruiters interested in offering scholarships. With this wrongful termination from New Caney's team, it is detrimental to her future education and promising athletic career. Her family and other interested parties will convene at the New Caney ISD School Board meeting on February 16th, 2015 to discuss the blatant violations of the UIL Soccer rules, the District's policy and the Constitution. It also seems there is a huge conflict of interest /conduct, being that the coaches in question are both coaching the same team while in a relationship. We would be grateful to any and all news outlets that will report on this matter in an unbiased and fair fashion.
